User Agreement

Introduction and Acceptance of Terms and Conditions

These Terms and Conditions as outlined below govern the contractual relationship between ‘Xtreme Wear’ (hereafter also referred to as ‘We’ or ‘XtremeWear.com’) and the ‘User’ (hereafter also referred to as ‘You’ or the ‘Customer’). By placing and confirming an order (whether by phone, e-mail or by using the DesignLab), we maintain that you have read and accept our general Terms and Conditions. These Terms and Conditions are important because they protect your rights as our valued customer, and our rights as a business.

Changes to the Terms and Conditions

Our Terms and Conditions could change at any time, and it is the User’s responsibility to stay up-to-date with our policies. Continued use of the website after the publishing of updated Terms of Service will be taken to mean that you have read and agree to any changes.

Website Access and Maintenance

XtremeWear.com is always changing. We reserve the right to update our website periodically, at our discretion, and without notice. While we make these changes, we try to ensure that our services are still available. However, we can’t guarantee that the website will not have downtime for any reason. We may close the website for general maintenance for short periods of time. We will not be liable if any part of our website is unavailable for any length of time.

 

Some sections of our website require a password for certain features (such as the DesignLab). This is to be able to save your designs and orders. When choosing a password, we highly recommend that it be hard for others to guess. We also recommend you log out at the end of every session. In the event you forget your password, there is a password-reset feature. If for some reason you believe your account information has been compromised, you are responsible for notifying us as soon as possible and, if log-in is possible, to change your password.

Products

XtremeWear.com puts high priority on accuracy in regards to product information, descriptions, and images. However, we will not be held responsible for any errors or omissions to any information given. We also cannot be held responsible for differences in color or appearance between online image and final product, as colors can appear differently on different displays.

 

We also work very hard to ensure that there is adequate stock to fulfill your order once it is submitted and paid for. However, if a product should become unavailable after your order has been placed, we can resolve the issue in a few different ways. We will offer you a similar replacement product or color, or a product of equal price. If you choose not to replace the product, you can either wait until the item is back in stock (if applicable) or we can cancel and refund your order.

Pricing

Prices shown on XtremeWear.com are in US Dollars. We reserve the right to alter our prices at any given time, but we will make every effort to notify you of any changes when your order is placed. If an incorrect price appears on our website for whatever reason (human error, technical error, etc) and your total at the time of order is not adjusted accordingly, we will reimburse you the difference.

XtremeWear.com offers SSL encryption to help keep your transaction secure.

Shipping & Delivery

Your order will be shipped to the address you designated when your order was placed. Orders placed via the DesignLab will be shipped to one address within the United States or Canada only.

 

Xtreme Wear works very hard to ensure that your order goes out on the date indicated on your order confirmation. We cannot be responsible for the consequences of late delivery or the loss of a package caused by a third party contracted to make delivery, or by you, or because of some unforeseen event or Act of God. If you do not receive your package, we can make a claim with the carrier and an investigation will be conducted. During this time, we cannot reimburse or re-deliver your goods.

Return Policy

Products via XtremeWear.com are made specifically for the Customer, and therefore cannot be returned. However, if there is a quality issue, or a mistake has been made by us, we will replace the products, offer you the shirts at a reduced price, or you can choose to receive store credit for the full value of your purchase. We have the right to request photo proof to verify any mistakes made.

 

Please note, it is the Customer’s responsibility to thoroughly examine all Order Confirmations and Design Proofs for accuracy. We are not responsible for errors if the finished order and/or design match the approved Order Confirmations and/or Design Proofs.

Reimbursements

The Customer will be reimbursed via the same payment method as was used when the order was placed.

Cancellations & Copyright Infringement

The DesignLab’s functionality allows Users to upload their own images for use on garments. Xtreme Wear maintains the right to cancel or revise your order if we feel that a User-created design infringes on the intellectual property or copyrights of others. If there is copyrighted material used in a User-created design, Xtreme Wear’s art staff will attempt to revise the design to remove and/or replace the copyrighted images. If this is not possible, your order will be cancelled and you will be refunded.

 

If you are licensed to use the registered logo or trademark of a third party, we have the right to request written permission from that third party. We will not process your order until permission is verified.

Privacy & Personal Data

The information that you provide to us is essential for the processing and delivery of your order and for billing purposes. Failure to provide certain details will result in cancellation of your order. By creating an account on our DesignLab, you agree to provide us with truthful information as it concerns you. Providing false information is contrary to our Terms and Conditions.

 

You have the right to access and modify all information that concerns you, in accordance with national law. You may contact us at any time to request what personal information we hold concerning you.

 

If you signed up for our mailing list, we will infrequently send out e-mails with new items, special offers, updates, etc. You can opt-out of these e-mails at any time by contacting us directly either by phone or by e-mail, or by following the “unsubscribe” link at the bottom of e-mails when applicable.

Intellectual Ownership

All content on XtremeWear.com (designs, text, logos, videos, etc) are the property of Xtreme Wear. Any partial or total reproduction of this content is prohibited without prior authorization by Xtreme Wear. Xtreme Wear cannot give you the right to copy, display, or distribute content that you do not have the intellectual rights to.
